Terms & Conditions of Service

Acceptance
If any instruction is received by Zafiato Inc from the Customer for the supply of products and/or services, it shall constitute acceptance of the terms and conditions contained herein. Upon acceptance of these terms and conditions by the Customer, the terms and conditions are definitive and binding.

Delivery, Damages, Shortages, Returns, and Refunds

Delivery: Our Delivery Policy applies to delivery of Products. Delivery is free for customers in our standard "Delivery Area" if order is placed within the applicable time. A nominal Fuel Surcharge may be applied while fuel and natural gas prices remain high.
Inspection: Products must be inspected for accuracy, and any damages upon delivery must be submitted in writing by email to hello@zafiato.ca or by phone to 519-688-3344 within 24 hours of receipt of order. Zafiato Inc is not responsible for shipments that are not claimed within such period as missing, damaged, lost, or wrong product.
Damages and Shortages: While we make every effort to pack and deliver your order accurately and securely, occasionally damages or missing items can occur during transit.
Returns: To return product, please call the Zafiato office at 519-688-3344 or email hello@zafiato.ca and arrange pickup. We will use our own delivery vehicles for pickup of returns. Please DO NOT return product with courier companies or other non-Zafiato third-parties.
Refunds: We only provide refunds for products that have been approved in writing and returned as approved by Zafiato Inc. A 20% restocking fee may apply, depending on the circumstances of the return.

Use of Products and Services

As a potential user of our Products and/or Services, you are authorized to use our website to research our Products and Services and access our content.
Restrictions. You are prohibited from using any Zafiato Inc content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, or provincial regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or access to any of our content for violating any of the prohibited uses.
Omissions, Errors. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
Modification. We reserve the right to modify or discontinue Products and Services at any time (or any part or content thereof) and without any notice.

Purchase of Products or Services

The Customer may request pricing from Zafiato Inc, setting out the price and quantity of the Products to be supplied. If the Quotation is acceptable to the Customer, the Customer may place an order within the timeframe stated on the Quotation.
Availability. Certain Products and Services may be available exclusively online through our site. These Products and Services may have limited quantities. We reserve the right to limit the quantities of any Products or Services that we offer.
Representation of Products. We have made every effort to display as accurately as possible the colours and images of our Products that appear on our site. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
Right to Limit Sales. We reserve the right, but are not obligated, to limit the sales of our Products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. Any description of Products or pricing is subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any Product at any time. Any offer for any Product or Service made on this site is void where prohibited.

Price & Payment

Prices. The price shall be as indicated on invoices provided by Zafiato Inc to the Customer in respect of Products and/ or Services supplied. Time for payment for the Products and/or Services shall be of the essence and will be stated on the invoice.
Changes to Prices. Prices for our Products and Services are subject to change with notice and based on market value.
Surcharge. Zafiato Inc reserves the right to implement a surcharge for cost of goods that are changing on the daily.
Taxes. Customer is responsible to pay the prices payable under each invoice issued by Zafiato Inc plus any applicable taxes, duties, excises, or other amounts payable under any relevant tax authority.

Late Payment / Default in Payment

Payment. Accepted methods of payment are cash, cheque, bank draft, direct deposit, credit card, debit card, or by any other method as agreed to between the Customer and Zafiato Inc.
Late Payment. Late payment shall incur interest at the rate of ? per annum calculated daily. Interest shall be payable on any amounts outstanding from the date payment was due until the date payment is received by Zafiato Inc, but without prejudice to Zafiato Inc other rights or remedies in respect of the Customer’s default in failing to make payment on the due date.
Title. Ownership and title to the Products remains with Zafiato Inc until the purchase price and all other monies owing by the Customer have been paid in full. Zafiato Inc shall be deemed to have been granted a security interest in respect of any Product which has been delivered to the Customer and for which the full purchase price remains unpaid.

Accuracy, Completeness and Timeliness of Information

Accuracy, Completeness. We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
Timeliness of Information. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.
